The following supply and sales conditions govern the business relationship between JAM Software GmbH, Am Wissenschaftspark 26, 54296 Trier - referred to in the following as JAM Software - and the customer for online-orders. For customers in Germany the German version of our terms and conditions is binding.
The following terms and conditions apply to the business relations between JAM Software and the customer in the version at the time the order was placed. Deviating regulations are not recognized by JAM Software unless they have written confirmation by JAM Software.
- Conclusion of contract, revocation
The contract between JAM Software and the customer is concluded as soon as the customer confirms intention to purchase by processing the payment or sending the signed fax form and when JAM Software confirms the order by the delivery of goods or login details via email. All objects of purchase remain property of JAM Software until full payment is received.
- Right of withdrawal
Private consumers have the right, according to § 3 of European Distance Selling Directives (§ 3 Fernabsatzgesetz) to revoke the purchasing agreement without stating a reason within a month after fulfillment of contract, however not before arrival of the goods and also not before fulfillment of our duty to inform correspondent to § 312c § 2 BGB. The customer can declare the withdrawal in written form (e.g. letter, fax, email), or by simply returning the goods.

- Consequences of withdrawal
If the withdrawal is made within the specified period, the customer is no longer bound to the contract with JAM Software. The purchasing price already paid by the customer will be reimbursed. The customer is obligated to send back the goods. If the withdrawal applies to goods less than 40 € and the goods suits the ordered products the customer will have to pay the costs of the return shipment. If the costs exceed this amount JAM Software will pay return shipment costs provided that the withdrawal has been sent within 30 days of receipt of goods.
The right of withdrawal does not apply to products that have been assembled according to customer specifications (e.g. customized software products) or to unsealed mediums or full versions of our software that have been downloaded from our customer’s area.

End of withdrawal instruction
The application of products purchased from JAM Software is strictly forbidden if people may be harmed when the products fail.
Updates & Support
Updates and support are free within the selected maintenance period after purchase. You are allowed to use the software as long as you want to. If your maintenance expires you will receive no more free updates or support, but you will be able to purchase a renewal for a reduced price in our customer's area. Maintenance includes support by email and phone during our business hours and the online availability of the licensed software and installation keys.
Applicable law and disputes
For the legal relations between the customer and JAM Software German law applies. Place of litigation for all claims in connection with the business relationship is Trier for general merchants. The right is reserved by JAM Software to seek jurisdiction at the place of litigation of the customer.
